Este ensayo ofrece una reconstrucción crítica del concepto de libertad de Norberto Bobbio. Un estudio histórico y analítico de su obra conduce a la identifi - cación de tres usos descriptivos del concepto de libertad: la libertad negativa o liberal, la libertad democrática o autonomía, y la libertad positiva, o de tipo socialista. En la segunda parte se analizan los alcances y las limitaciones de estos tres conceptos de libertad y se subrayan la insufi ciencia de la dicotomía entre libertad (...) negativa y positiva, la incompatibilidad del concepto del concepto de libertad negativa con la libertad reforzada de los derechos fundamentales y con la fundamentación independiente de los derechos sociales. Every modern legal system is made up of two basic kinds of norms: rules and principles. These are applied by means of two different procedures: subsumption and balancing. While rules apply by means of subsumption, balancing is the means of applying principles. Balancing has therefore become an essential methodological criterion for adjudication, especially of constitutional rights. However, balancing is at the heart of many theoretical and practical discussions. One of the most important questions is whether balancing is a rational procedure (...) for applying norms. The aim of this paper is to consider whether this is the case. To achieve this aim, this paper reflects on why the rationality of balancing is in doubt, and to what extent balancing can be rational, and how this can be possible. The weight formula proposed by Robert Alexy is analysed as a model which, in spite of its limits, tries to solve the philosophical and constitutional problems about the rationality of balancing to the greatest extent possible. Este trabajo tiene como objetivo general examinar los elementos que conforman el no-positivismo inclusivo; postura epistemológica y filosófica desarrollada a través de los años por Robert Alexy. Los métodos empleados son el deductivo, analítico y dialéctico; la principal técnica utilizada ha sido la investigación documental. El presente documento, grosso modo, se encuentra dividido en tres apartados. Primero, son explicados los elementos que conforman el no-positivismo inclusivo de Robert Alexy. Segundo, se explican algunas críticas formuladas a los elementos constitutivos del no-positivismo (...) inclusivo con base en las ideas de Riccardo Guastini, Juan Antonio García Amado, Joseph Raz, Eugenio Bulygin, Matthias Klatt, Carlos Bernal Pulido; entre otros autores. Por último, en tanto objetivo particular, se expone una reflexión con el propósito de indicar uno de los múltiples caminos que los estudios jurídico-científicos sobre el no-positivismo inclusivo podrían seguir en el porvenir. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

Cet article prétend expliquer l'invisibilité relative du conflit armé colombien par rapport à d'autres situations de crise internationale. Au lieu de présupposer que le problème repose sur une faible médiatisation des événements rapportés à la Colombie, il se penche sur les tentatives de mise en sens des événements effectuées par les journalistes au moment de leur médiatisation. L'argument central est que l'opacité du « problème colombien » sur la scène internationale est surtout liée à la difficulté de parvenir à élaborer (...) un récit capable de rendre intelligible ce qui se passe en Colombie.This article tries to explain the relative invisibility of the Colombian armed conflict in relation to other international crisis situations. Instead assume that the problem lies in a low media coverage of events reported to the British, it focuses on the attempts of making sense of the events conducted by journalists at media coverage. The central argument is that the opacity of the "Colombian problem" on the international scene is mainly due to the difficulty of reaching to develop a story that can make sense of what is happening in Colombia. Based on the most recent metanalysis on the efficacy and safety of the human papilloma virus (HPV) vaccine, thevicissitudes in the gynecological, ethical, and bioethical fields are explored. A review of the bibliography on thesubject is made. As one of the justifications for the vaccine is the prevention of endocervical cancer, viable alter-natives for its early detection and treatment are shown and discussed. Some ethical limitations that this vaccinehas shown are analyzed. It is concluded that there is a need to (...) rethink the management of certain diseases withvaccines, achieve greater transparency in the pharmaceutical industry, resizing evidence-based medicine, anddesign educational strategies that promote behaviors that are in accordance with the nature of human sexuality -/- . Este artigo examina o papel desempenhado por Schafick Jorge Handal no processo de conversão política do Frente Farabundo Martí para a Libertação Nacional, no período de pós-guerra. Aqui são analisados os principais debates vinculados à redefinição política e ideológica do FMLN, à liderança do partido e à democracia interna. Este processo foi marcado por fortes disputas entre as lideranças das antigas organizações político-militares que compunham a FMLN. Handal foi o principal protagonista dessas lutas, nas quais que ganhou poder e reconhecimento (...) interno. No entanto, ele morreu subitamente em 2006, quando o processo de ‘unificação’ estava avançado, mas não consolidado. Porém, na memória oficial do partido, Handal tornou-se o principal referente identitario do FMLN de pós-guerra, apesar de que seu triunfo traduziu-se na saída de três das cinco organizações que integravam o FMLN. In this note, the problem of tracking random references and rejecting random perturbations in a quadrotor, both generated by an auxiliary system named exosystem, is solved by extending the deterministic tracking problem to the area of stochastic processes. Besides, it is considered that only a part of the state vector of the quadrotor is available through measurements. As a consequence, the state vector of the plant must be estimated in order to close the control loop. On this basis, a controller (...) to track random references and to reject random perturbations is developed by combining a Kalman filter to estimate the references and perturbations of an exosystem and an observer to estimate the states of a quadrotor. Besides, to obtain a more practical controller, the analysis is carried out in discrete time. Numerical simulations are used in a quadrotor to confirm the validity and effectiveness of the proposed control. (shrink)

En los criterios estructurales se distinguen estas temáticas: mito e identidad, relaciones con el otro, imagen y memoria, y la reconstrucción de lo que somos y seremos. Se tuvieron en cuenta franjas temporales de ocho años, desde el momento de su (...) publicación, 1975, hasta el año 2015. Los estudios destacan los problemas de la identidad latinoamericana, la intertextualidad, la multiculturalidad y la conquista; revelan su actualidad en el siglo XXI a través del mestizaje, las tradiciones culturales del Viejo y el Nuevo Mundo, y los otros mundos; y expresan, así, la necesidad de reconstruir un nuevo humanismo. Cacao cultivation is one of the most important livelihoods for rural households in Colombia, where it is promoted as a substitute for the illegal cultivation of coca. To strengthen Colombian cacao farming, it is important to understand the livelihood strategies associated with cacao cultivation and the impact of these different strategies on the well-being of Colombian rural households. We analyzed the impact of cacao cultivation on the livelihood strategies and well-being of rural households in western Colombia. Research with 92 rural (...) cacao-growing households produced a typology of household livelihood strategies derived from their approach to cacao production. Indicators of each household capital and level of well-being were identified for each type of households. Correlations between the capitals and the capitals of greater importance in shaping the well-being of rural households were analyzed. Three types of rural households were identified: Cacao Farmers, Diversified Farmers with Cacao, and New Cacao Farmers. Cacao farmers have the highest capitals endowments and level of well-being, followed by Diversified Farmers with Cacao, and New Cacao Farmers. The conditions of cacao cultivation in rural households result in differentiated access to resources from capitals; households with better development of the crop have consolidated greater well-being where human capital has been its major driving factor. Success of the cacao crop and its relationship with well-being of rural households depends on the convergence of different capital resources. Thus, institutional efforts to strengthen the cacao sector in Colombia must go beyond investment to establish new hectares and consider aspects such as: Strengthening the skills and knowledge of producers to improve crop management practices, Promoting the participation of household members in associations, Stimulating sensitivity to the rooting and sustainable management of the crop, and Promoting processes of technification and adaptation of the infrastructure of fermenters and dryers, which will make it possible to guarantee an adequate quality of the cacao bean. Research in the discipline of international relations finds that the great democratic powers are less likely to pursue revisionist policies. This investigation challenges this argument by showing that the United States' decision to oust Saddam Hussein's regime in March 2003 was consistent with a modified version of John Mearsheimer's theory of offensive realism, which finds that great powers' motivation is global hegemony. This article is divided into three sections. The first section considers the value of Mearsheimer's theory and reworks it (...) by adding domestic variables to explain why states abandon defensive strategies for offensive ones. The second section shows how pre-9/11 American foreign policy strategy was, for the most part, status quo oriented, and section three explains why and how the Bush administration introduced a revisionist foreign policy strategy after the 9/11 attacks. This investigation concludes by showing how the 2003 Iraq War is the first step in the United States' quest for global hegemony. (shrink)

It continues work in the area by the authors and Peter Gärdenfors. The paper defines a notion of safe contraction of a set of propositions, shows that it satisfies the Gärdenfors postulates for contraction and thus can be represented as a partial meet contraction, and studies its properties both in general and (...) under various natural constraints. Recent work in the philosophy of biology has attempted to clarify and defend the use of the biodiversity concept in conservation science. I argue against these views, and give reasons to think that the biodiversity concept is a poor fit for the role we want it to play in conservation biology on both empirical and conceptual grounds. Against pluralists, who hold that biodiversity consists of distinct but correlated properties of natural systems, I argue that the supposed correlations between these properties (...) are not tight enough to warrant treating and measuring them as a bundle. I additionally argue that deflationary theories of biodiversity don’t go far enough, since a large proportion of what we value in the environment falls outside bounds of what could reasonably be called “diversity”. I suggest that in current scientific practice biodiversity is generally an unnecessary placeholder for biological value of all sorts, and that we are better off eliminating it from conservation biology, or at least drastically reducing its role. In a context of pervasive digitalization of the social world, both before and during the COVID-19 pandemic, the field of education has undergone major changes with the development of digital practices and settings. However, the physical presence of the subjects and the body remain something primordial and irreplaceable in traditional educational processes. Thus, it is often assumed that virtuality is opposed to the corporeal reality of the subjects involved in teaching, learning and studying. In this paper we aim to critically (...) challenge this assumption by addressing the phenomenon of virtuality in a more original sense: as a fundamental dimension of corporeality itself. Drawing on Merleau-Ponty’s phenomenological insights, we argue that the experience of the virtual is inherently embodied and fully real. We understand corporeality and virtuality as entangled and multidimensional phenomena. At the same time, this leads us to rethink the digital as only one possible medium in which virtuality can appear as inherent to embodied experience. We develop our phenomenological approach in three instances. First, we question and bracket two common assumptions about corporeality. From our critical perspective, assumptions about a disembodied digitality and a devirtualized corporeality represent extremes within which educational discourses currently move. Second, we address the inherent virtuality of embodied experience. We outline the heuristic concept of the virtual body to describe corporeality and virtuality as entangled and multidimensional phenomena that encompass extension, intercorporeality and intermediality. Finally, we make some remarks on the relationships of corporeality and virtuality considering the challenges of digital education. (shrink)

La presente obra constituye el esfuerzo por rastrear la historia del pensamiento cosmovisional y filosófico latinoamericano, desde las cosmovisiones pre-colombinas hasta las corrientes filosóficas más actuales: las filosofías de la liberación, la postmodernidad y la postcolonialidad. Aunque el autor ha procurado en su voluminosa obra hacer referencia a todas las numerosas corrientes de pensamiento que se han ido dando en el amplio panorama cultural latinoamericano, se ha centrado sobre todo en rastrear la denominada filosofía americanista.

O presente artigo aborda as concessões feitas por Husserl no texto de Prolegômenos, na segunda edição de Investigações Lógicas. O artigo mostra que a concessão mais difícil estaria exatamente na manutenção da ideia de “verdade em si”. Por um lado, Husserl afirma que a “verdade em si” não poderia depender da constituição da natureza humana, pois tal dependência abalaria o próprio sentido da ideia de “verdade”. Por outro lado, não deixaria de reconhecer a insuficiência da ideia de “verdade em si”, (...) na medida em que tal ideia encobriria o importante problema da relação entre o real e o ideal. (shrink)

A descriptive-exploratory analysis of assurance practices is presented in this paper, by analysing the patterns of sustainability assurance reporting in two national contexts with different levels of assurance activity over a period of 11 years. The study is based on theoretical insights drawn from institutional sociology and normativity production. It is framed both in the Italian situation, where assurance statements consistently include a narrow set of formal and procedural communications, and in an unsettled situation in the U.S., where assurance activity (...) is more incipient, but where experimentation in substantial assurance disclosure practices has more room to develop. Its main implication is that the diffusion of sustainability assurance and the creation of sustainability assurance disclosure norms are not without its cost: information quality does not increase with patterned practice. The results also point towards the noteworthy role of specific professionals in the earlier and later stages of assurance practice norms. They reveal a significant influence of non-Big4 firms in the diffusion of sustainability assurance disclosure norms. In contrast, the Big4 firms appear to be positively associated with the narrowing down of the assurance focus to a selected subset of this activity in later stages of the development of the assurance norm. In this regard, this study provides insight into the circumstantial—but relevant—carrier role of the Big4 firms in determining what “assurance” means. (shrink)

IN THE DISCUSSION on education in the Republic, Socrates lays down the principles which those who speak about the gods must follow if they want to avoid the errors of traditional mythology. The first typos of this rational theology is this: "God is the cause, not of all things, but only of the good." For "God, being good, cannot be responsible for everything happening in our life, as is commonly believed, but only for a small part. For we have a (...) far smaller share of good than of evil, and while God must be held to be the sole cause of good, we must look for some other factors than God as cause of the evil." Rightly celebrated, this passage has set the agenda for ages of reflection in Western thought on the cause of evil. In contrast to traditional mythology where the gods are seen as the origin of both good and evil--as Homer says, "Zeus has two jars standing on the floor of his palace, full of fates, good in one and evil in the other"--the divinity is now freed of all responsibility for evil. God, who is entirely good, can only be the cause of well-being. If this answer sets God free of all responsibility for evil, it seems to be at the cost of limiting God's power: for God is no longer responsible for "most things in human life," since most of them are evil. What, then, may be the cause or causes of evil? Do bad things have a cause? Or do they just happen? Plato's formulation seems to suggest that he favours a dualistic solution to the problem of evil: God is the cause of all good, but for evil we have to find other causes. What could those causes be: matter, cosmic necessity, an evil soul? Various answers of this type were developed in later Platonism and in later mythological philosophies. Without denying that Plato often uses a dualistic discourse and uses elements of it in his cosmology, I do think that Plato had something different in mind. After all, he was not primarily interested in the problem of theodicy. For in this passage of the Republic, he is not concerned with the problem of evil in the universe as a whole, which is really the theodicy question, but with evil in "human life," that is, evil insofar as human beings experience it and suffer from it: the fact that we are not at all living well but are instead miserable and unhappy. This paper examines accounts of the moral wrongness of killing persons in addition to determining what conclusions, if any, can be drawn from the morality of killing persons about the equality of persons, and vice versa. I will argue that a plausible way of thinking about the moral wrongness of killing implies that the permissibility of killing innocent, nonthreatening persons depends on a person’s age. I address objections to this conclusion and discuss some potential implications of the view.

En este trabajo, el autor analiza las contradicciones que el multiculturalismo plantea en las sociedades actuales, resaltando la importante mediación que el sistema político democrático lleva a cabo en la resolución de las mismas. A partir de los artículos de tres autores ('The Politics ofRecognition" de CH Taylor: "Struggles for Recognition in Constitutional States" de J. Habermas y "Legitimacy and Diversity: Dialectical Reflections on Analytical Distinctions" de T. McCarthy) y de la referencia final al trabajo de Rawls 'The Law of (...) the People", expone una serie de momentos teóricos que representan diferentes estadios en la discusión entre el pensamiento liberal y el comunitarismo, y que componen un proceso explicativo en el que cada uno de esos momentos supondría una superación teórica del anterior. En concreto, el autor trata de situar la discusión sobre el reconocimiento del derecho a la diferencia, en el terreno en el que del análista del modelo teórico del liberalismo más acorde con el reconocimiento de derechos a las colectividades-el republicanismo comunitarista al que se refiere Taylor-, se pase al análisis del tipo de sistema político dentro del cual se reconozca la diferencia y la existencia de otras culturas como algo que ya estaba implícito en la teoría de los derechos. Este sistema político sería la democracia deliberativa y su procedimiento discursivo para tomar decisiciones y llegar a acuerdos, propuesto por J. Habermas. El trabajo de McCarthy tratarla de resolver algunas fisuras en la democracia deliberativa que afectarían a su legitimidad por cuanto suponen un menoscabo a la idea misma de las diferencias. Finalmente, la alusión a Rawls permite al autor erigir el sistema de los derechos humanos en el estándar mínimo necesario para llegar a un acuerdo global lo suficientemente amplio y abstracto como para garantizar el máximo respeto a las diferencias. Un acuerdo que, insiste el autor, sólo puede enmarcarse en un proyecto democrático con dimensión internacional, al que llama "horizonte cosmopolitamente democrático". (shrink)
